SnakeCo Terms of Use
1. Who we are and what these terms cover
SnakeCo (the "Game") is made and published by DGM Technology OÜ, Tallinn, Estonia ("we", "us"). These terms are the agreement between you and us about using the Game. By installing or playing it you accept them. The Google Play Terms of Service also apply to your purchase and download, and our Privacy Policy explains how data is handled.
If you are under the age of majority where you live, please read these terms with a parent or guardian.
2. Your licence to play
When you obtain the Game through Google Play, we give you a personal, non-exclusive, non-transferable licence to install and play it for non-commercial purposes on Android devices that you own or control, as allowed by Google Play (including Google Play Family Library, where available). You may not:
- copy, sell, rent, share or redistribute the Game or a modified version of it;
- extract, reuse or publish its images, sounds, voice recordings or other content outside the Game;
- remove or get around its purchase check, or decompile or reverse engineer it, except where the law expressly allows this.
The Game is licensed, not sold: we keep all rights not expressly given to you.
3. Price, payment and refunds
- The Game is sold on Google Play at the price shown there, including any taxes Google applies in your country. Google Play processes the payment; we never see your payment details.
- Refunds are requested from Google Play and follow Google Play's refund policies. If you have a problem with your purchase, you are also welcome to write to us; we will help where we can.
- Right of withdrawal (EU/EEA): the Game is digital content supplied immediately. When you buy it, Google Play asks you to agree that the download starts right away; by doing so you lose the 14-day right of withdrawal once the download has started. This does not affect your right to a working Game (section 7).
- The price is the same for everyone in a country at a given time; we may change it in the future. A change never makes you pay again for a copy you already bought.
4. Early buyers and ads
The current version of SnakeCo has no ads. We may decide in the future to offer the Game for free with ads. If we do:
- Players who bought the Game while it was paid will keep playing without ads. The Game recognises them through the purchase confirmation from Google Play that it saves on the device and in the player's own Google backup (see our Privacy Policy). For this to work, open the Game at least once while it is still sold as a paid app.
- If the Game cannot find your confirmation (for example on a new phone with backups turned off), write to snakeco@flashylearning.app with your Google Play order number (it starts with "GPA."). Once we have confirmed in Google Play that the purchase was made before the change and was not refunded, we will give you a free way to remove the ads, such as a Google Play promo code for the "Remove ads" option.
- This does not apply to purchases that were refunded or cancelled, or to copies not obtained from Google Play.
We will announce such a change in the Game's Google Play listing and update these terms before it happens. We do not promise that the Game will ever change in this way.
5. Updates and availability
The Game works offline. We may release updates that fix problems, add places or change features; some may be needed to keep the Game working on newer Android versions. Places shown as "coming soon" are plans, not part of what you buy today. Google Play normally lets buyers download the Game again on their devices. We cannot guarantee that it will work on every future device or Android version.
6. Content, art and credits
- The Game, its code, design, characters, texts, music, sounds and the SnakeCo name and logo belong to DGM Technology OÜ.
- The pictures of the foods, coffee bushes, palm trees, the cannon and the landscapes were generated with artificial intelligence for SnakeCo and then selected and edited by us. The mascot was redrawn as a vector drawing from an AI sketch. The Spanish voice reactions are our own recordings. The sounds and the surprise salsa are generated by the Game itself.
- Colombian foods and places appear as part of Colombian culture. SnakeCo is not connected to, sponsored or endorsed by any brand, business, city or government.
- The Game uses parts of Google's License Verification Library under the Apache License 2.0.
7. Our responsibility
- Your consumer rights come first. If you are a consumer in the EU/EEA, you have legal rights if the Game does not work as described (for example, to have it fixed or, failing that, a price reduction or refund). Nothing in these terms limits those rights or any other rights the law of your country gives you.
- Apart from those rights, the Game is provided as it is. We work to keep it free of bugs, but we cannot promise that it will never have errors or interruptions.
- We are fully responsible for damage we cause intentionally or through gross negligence, and for death or personal injury caused by our negligence. Otherwise, as far as the law allows, our total responsibility to you is limited to the price you paid for the Game, and we are not responsible for indirect losses such as lost scores or data on your device.
8. Playing safely
Take regular breaks. The Game has moving colours and quick visual effects; if you or a family member have had seizures or epilepsy, ask a doctor before playing. Please don't play where you need to pay attention to your surroundings, such as while walking or driving.
9. Ending this agreement
You can stop at any time by uninstalling the Game. If you seriously break these terms (for example by distributing copies of the Game), your licence ends. Sections 6, 7 and 10 continue after that.
10. Law and disputes
These terms are governed by the law of Estonia. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can take legal action in the courts of that country. Otherwise, disputes go to Harju County Court (Harju Maakohus) in Tallinn.
Please contact us first: most problems can be solved by email. Consumers can also ask the Estonian Consumer Disputes Committee, through the Consumer Protection and Technical Regulatory Authority (www.ttja.ee), or the consumer authority in their own country for help.
11. Changes to these terms
We may update these terms, for example when the Game gets new features or the law changes. We will publish the new version here with a new effective date. Changes never take away rights you already have for a copy you bought, and important changes will be mentioned in the Game's release notes.
